    For any client that requests to unsubscribe from your SMS service, notify them of the following:

    Unsubscribe function works as follows: Reply with the Keyword "STOP" to absolutely any SMS and the system will then mark the user as "unsubscribed".

  • *Unsolicited marketing. What constitutes as SMS SPAM?
    SPAM Definitions as per WASPA code of conduct:

    “Spam” means unsolicited commercial communications, including unsolicited commercial messages as described below:

    Any commercial message is considered unsolicited (and hence spam) unless:

    (a) the recipient has requested the message;
    (b) the message recipient has a direct and recent prior commercial relationship with the message originator and would reasonably expect to receive marketing communications from the originator; or
    (c) the organisation supplying the originator with the recipient’s contact information has the recipient’s explicit consent to do so.

  • Is your SMS competition a pure "lottery" type SMS Competition, i.e. clients who offer cars, etc as a prize? Is it a pure money-making exercise?

    The National Lotteries Board has been established in terms of the Lotteries Act, No. 57 of 1997 to regulate all lotteries in South Africa. The definition of a lottery in terms of the Act is “any game, scheme or plan where the prize is distributed by luck or chance”. In other words if there is a “draw” to determine the winner, it is a lottery.

    Only two types of lotteries are legal i.e. the National Lottery “Lotto” and “raffles” conducted by non-profit organisations. All others are therefore illegal.

    However, a company or profit making entity may conduct promotional competitions. A promotional competition is a lottery whereby goods or services of that specific entity are being promoted for example Coke or Vodacom. It is of vital importance that the promotional aspect of the competition is being clarified. If for example a competition is conducted where the public sms or enter into the competition, without a specific product being promoted i.e. “sms a number and you can win a car”, then that competition is an illegal lottery and not a promotional competition as nothing is being promoted.
